Welcome to ApkiVoice. These Terms of Service ("Terms") govern your access to and use of the ApkiVoice platform, including our website, APIs, and voice AI services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
By creating an account or using ApkiVoice, you confirm that:
- •You are at least 18 years of age
- •You have the legal capacity to enter into a binding agreement
- •You will comply with these Terms and all applicable laws and regulations
- •If using on behalf of an organization, you have authority to bind that organization to these Terms
2. Description of Service
ApkiVoice provides a voice AI platform that enables you to:
- •Create and configure AI-powered voice assistants
- •Make and receive automated phone calls
- •Utilize speech-to-text (STT) and text-to-speech (TTS) services
- •Integrate large language models (LLMs) for conversational AI
- •Rent phone numbers for inbound and outbound calling
- •Access call recordings, transcriptions, and analytics
3. Account Registration
To use ApkiVoice, you must create an account. You agree to:
- •Provide accurate, current, and complete registration information
- •Maintain and update your information to keep it accurate
- •Keep your password secure and confidential
- •Notify us immediately of any unauthorized access to your account
- •Accept responsibility for all activities under your account
4. Credits & Payments
Pay-Per-Use Model
ApkiVoice operates on a credit-based, pay-per-use model. You purchase credits which are consumed based on your usage of various services.
Pricing
Pricing varies based on the providers you select (STT, TTS, LLM) and is charged per minute of call time. Current pricing is available on our pricing page.
Phone Numbers
Phone number rentals are billed at $1.30 per month per number. Numbers may be reclaimed if your account becomes inactive.
Refunds
Credits are non-refundable once purchased. Unused credits remain in your account and do not expire.
Price Changes
We reserve the right to modify pricing with reasonable notice. Continued use after price changes constitutes acceptance.
5. Acceptable Use
You may use ApkiVoice for legitimate purposes, including:
- •Customer service and support automation
- •Appointment scheduling and reminders
- •Lead qualification and sales outreach (with proper consent)
- •Surveys and feedback collection
- •Internal business communications
6. Prohibited Activities
You must NOT use ApkiVoice to:
- •Make unsolicited calls (spam) or violate telemarketing laws
- •Engage in fraud, scams, or deceptive practices
- •Harass, threaten, or abuse any person
- •Transmit illegal, harmful, or offensive content
- •Impersonate others or misrepresent your identity
- •Violate call recording consent laws in applicable jurisdictions
- •Reverse engineer, decompile, or attempt to extract source code
- •Interfere with or disrupt our services or infrastructure
- •Resell or redistribute our services without authorization
7. Intellectual Property
Our Property
ApkiVoice, including its software, design, logos, and documentation, is owned by us and protected by intellectual property laws. You receive a limited, non-exclusive license to use our services.
Your Content
You retain ownership of your data, including call recordings, transcriptions, and assistant configurations. You grant us a license to process this content solely to provide our services.
8. Third-Party Services
Our platform integrates with third-party services including Twilio, Deepgram, ElevenLabs, OpenAI, and other providers. Your use of these services through ApkiVoice is also subject to their respective terms and policies.
We are not responsible for the performance, availability, or policies of third-party services. Service quality may vary based on your selected providers.
9. Data & Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You are responsible for ensuring your use of ApkiVoice complies with applicable data protection laws, including obtaining necessary consents for call recording where required.
10. Service Availability
We strive to provide reliable service but do not guarantee 100% uptime. Services may be temporarily unavailable due to:
- •Scheduled maintenance (we will provide advance notice when possible)
- •Unplanned outages or technical issues
- •Third-party service disruptions
- •Circumstances beyond our reasonable control
We reserve the right to modify, suspend, or discontinue any part of our services at any time.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- •Our services are provided "AS IS" without warranties of any kind
- •We do not guarantee the accuracy of AI-generated responses
- •We are not liable for indirect, incidental, or consequential damages
- •Our total liability is limited to the amount you paid us in the past 12 months
12. Termination
By You
You may close your account at any time. Unused credits will not be refunded upon account closure.
By Us
We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited activities, or for any other reason at our discretion with notice where practicable.
Effect of Termination
Upon termination, your right to use our services ceases immediately. We may delete your data after a reasonable retention period.
13. Governing Law
These Terms are governed by applicable laws. Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or in courts of competent jurisdiction.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of ApkiVoice after changes constitutes acceptance of the new Terms.
